This terms and conditions apply to all types of kitesurfing / windsurfing / kite foiling / wing foiling lessons or rentals provided by Paroskite to participant (and the parent or legal guardian of participant if participant is a minor). These General Terms and Conditions (GTC) apply to all courses, rentals, offers and agreements, the entire business relationship and contract management between PAROSKITE (hereafter referred to as PAROSKITE) and its customers.
Participant can apply for the kitesurfing lessons in person or by e-mail. By signing the application form for participation to the kitesurfing lessons the participant/tenant accepts this terms and conditions. If applying through e-mail, the participant accepts this terms and conditions when he agrees to book the lessons. The terms and conditions are available on our internet site (www.www.paroskite.com).
Any person who is able to swim for fifteen minutes in the open sea and has no health problems is eligible to participate in all types of courses or rentals. If the participant has known health issues (e.g., asthma, diabetes, allergies, etc.), the instructors or the Paroskite station personnel must be informed prior to commencing the course. Each participant must have valid health insurance and appropriate liability or accident insurance.
The instructions of PAROSKITE staff are to be followed at all times.
Course registrations will be confirmed in writing. The booking only becomes binding for both parties after a deposit of 40% / participant has been paid. Deposits must be paid into our bank account or can be given in cash. The balance is to be paid on site before the start of the lessons and can be paid in cash or with a credit card. A surcharge fee will be charged for on-site credit card payments.
Please note: Bank transfer and Paypal charges may apply and you must take this into consideration when making your payment.
We will not accept payment transfer costs or confirm your booking until the full amount, as stated on your invoice, is received by us. All prices are quoted in Euros. All prices advertised on our website are accurate when published, however we reserve the right to alter prices at any time. Any changes will be made clear at the time of booking.
Any cancellations or changes to the booking must be made in writing and will only be accepted from the date they are received by Paroskite. Cancellation must be received in writing from the “main guest” or “agent” who made the booking three weeks before arrival or commencement of activity.
We will refund you the amount paid, minus € 25.00 administration costs or any costs involved with this bank transfer. Cancellation of your booking within two weeks prior to your arrival is non- refundable.
Failure to show for your activity at the agreed time on the agreed date is non-refundable. In case a cancellation request is received later than 2 days before the start of the activity, the fees paid for that activity are non-refundable. Change of mind (for any reason) and in case you’d wish to stop with the activity is non-refundable.
Participant can cancel a lesson at his/her own request. In this case, no refund for the payed amount will be provided and transfer of the booked service to a third person is not possible.
If you or any member of your party arrives for activities under the influence of alcohol or drugs, you may be refused participation and will not be refunded. The parent or legal guardian of a minor must be present throughout the course of an activity or the minor may be removed from the activity.
Once your booking is confirmed we cannot ensure that changes can be accepted. Those requests we are able to consider will be subject to availability. If the activity you request is more expensive than your original choice, full payment must be made prior to the activity taking place.
All kitesurf courses are set and coordinated on a strict timetable with other bookings and we are unable to change this at short notice.
Your booking is very important to us and for this reason we will do our very best provide you with all services done by your booking. In the unlikely event that we fail to do so, we will always offer suitable alternative, subject to availability. If we are unable to offer you a suitable alternative, we will refund your payment (excluding activities cancelled due to adverse weather conditions) and consider the matter settled.
If PAROSKITE decides that wind or water conditions are not suitable for training, an alternative date or an alternative program will be offered to the full extent.
In the event of force majeure (storm, illness, theft, etc.), PAROSKITE reserves the right to withdraw from the contract without notice. In such cases, participants cannot assert any claims for cancellation or compensation. Any amounts paid will be refunded.
If participant arrives for the lessons with delay and no previous communication, Paroskite is not obliged to wait for him/her or start later. Τhere will be no refund if the participant does not appear or cannot be reached. In the case of unexcused absence or voluntarily cancellation of lessons, no compensation for the missed course can be claimed
Participant/tenant is obliged to take care of his/her own safety, safety of other participants and other persons in vicinity. Participant must be in the best of health and has to declare any medical conditions that may affect his/her or others safety whilst participating in kitesurfing / surfing lessons. When in doubt, Paroskite recommend to consult a family doctor.
During the practicing of kitesurfing or any type of lessons participant should not be under influence of alcohol, drugs or other sedatives. The lessons are managed by instructors and Paroskite. Participant has to consider and respect their instructions during the practice. The instructor may suspend a student from the lessons, if he/she is behaving dangerously. In this case Paroskite will not refund any money.
The participant is obligated in case of any performance disruption to do everything reasonable for him, in order to contribute to a correction of the disturbance and to keep the possible damage as small as possible. All required equipment (kite, bar, board, harness, helmet) for the activity will be provided by Paroskite unless participant has his/her own equipment.
Use of all safety equipment is highly recommended by Paroskite, if participant refuses to use it during tuition or rental, he/she takes all responsibility for all possible damages arising out of that.
Paroskite equipment will be used during the lessons, unless previously agreed that participant will use his/her own equipment. Safety and operational readiness of all equipment is maintained by regular inspections. However, the participant/tenant is obliged to check equipment before use. Before using any kind of equipment, Paroskite instructors will make a quick test of tenant s kitesurfing or windsurfing or wing/foiling knowledge.
Fore rentals, tenant has to be able to stay up wind, if he/she is not sufficiently skilled to handle the rental gear, Paroskite will refuse the rental and give instead tuition. Participant/tenant has to use all equipment in accordance with the purpose of use and with care. In case of damage or loss of equipment by participant/tenant or third person, a member of Paroskite staff has to be informed immediately.
Participant/tenant has to manage the equipment according to the instructions, if not, the instructor may forbid him/her to use the equipment any longer without compensation. PAROSKITE ensures its operational readiness through regular checks of the material. Nevertheless, every participant/renter is obliged to check the equipment before starting the session and to report any damage that occurred before the start of the session or during the session.
If the operational readiness of the equipment is no longer guaranteed due to nonobservance of the instructor’s instructions or due to negligent or intentional behaviour on the part of the participant/renter, the participant is not entitled to compensation for the time lost due to the factual assessment and troubleshooting.
By accepting this terms and conditions participant/tenant agrees, that his/hers personal data can be used for needs of Paroskite, marketing/promotions and for notification about offers from Paroskite. This personal data will not be forwarded to third parties if they are not connected with Paroskite.
During the kitesurfing lessons photos and videos can be taken by Paroskite. By accepting this Terms and conditions, participant grants Paroskite the right to use the photos and videos of him/her for promotional purposes. Personal data is only collected and stored if participants/tenants voluntarily contact PAROSKITE in the context of an order, booking or registration.
By providing an e-mail address, the customer agrees to receive notices of order, booking/registration and information material via e-mail until further notice. This consent can be revoked at any time by e-mail to info@www.paroskite.com During class, photos and videos may be taken.
By participating in the courses, the participants grant PAROSKITE the right to use the photos free of charge for further advertising purposes. If a participant does not agree with the publication of material on which he/she is visible, the right of use can be revoked at any time by e-mail to info@www.paroskite.com
Paroskite reserves the right to change the content of this Terms and conditions at any time.
If any part, article, paragraph, sentence or clause of this Terms and conditions is not enforceable, the affected provision shall be curtailed and limited only to the extent necessary to bring it within the requirements of the law, and the remainder of the agreement shall continue in full force and effect. PAROSKITE reserves the right at any time to change the contents of the General Terms and Conditions as well as their website.
This Terms and Conditions are in addition to and are not intended to replace any other agreements related to liability for sports injuries, damage or loss, that participant/tenant (or participant s/tenant s parents or legal guardians) may have signed, either in the past or in the future.
To the extend that there is any conflict between the documents, participant/tenant (and participant s/tenant s parents or legal guardians) intends to be subject to the document that provides the most expansive release of claims and assumption of risk allowed by law.
By signing the application form for participation at kitesurfing/windsurfing/foiling lessons or rentals or when applying through internet or phone, the participant/tenant claims that he/she has read and understood the terms and conditions of Paroskite and that he/she will act according to these rules.
If participant/tenant is a minor, written consent of the legal representative must be provided.
Kitesurf equipment can only be rented in case the following conditions are met:
(a) The renter signs an agreement that the renter is liable for all damages to the rented materials. If the renter doesn’t report any damage that was there before the time of rental, the renter will be held liable for this as well. We advise you to always check your materials before usage!
(b) The renter shows one of our instructors that he is able to kite independently.
(c) The renter waives all rights to hold us liable for any personal injuries.
(d) The renter agrees that in case any of our instructors sees him mistreating the rented materials, the rental contract will be terminated immediately, which means that the materials need to be returned to our office and no claim for refund can be made.
The rental of kitesurfing or windsurfing or wing foiling equipment is only after presentation of a corresponding certificate of competence (for example, VDWS Level 4 and more, IKO Level 3 K and more, etc.) If the participant does not possess a license, but he/she maintains the appropriate skills, PAROSKITE reserves the right to assess the competence of the participant for a fee.
If, after the rental period has started, a lack of qualification nevertheless emerges (violation of the rules of driving, endangering other beach visitors or participants in water sports), PAROSKITE reserves the right to collect the material and end the rental period.
Already made payments will not be refunded. For all rentals, the renter is liable for replacement of lost or deliberately damaged material at its current value. Any deposit paid will be deducted pro rata for such damage.
If a kitesurf course was booked that was not included in a package:
In case we were unable to provide 90% of the reserved kitesurf course and one the following conditions are met: (a) the wind conditions prohibited you from completing your course (the wind is under 8 knt or over 30 knt), the unused hours will be refunded.
For this refund we will first calculate what course has been reached and calculate the price per hour based on that course. Example: You booked a 9-hours course for € 280.00 and were only able to do 7 hours of your course, the following calculation will be made for your refund (given that in this example a 6-hours course is € 200.00): ((€ 280.00 – € 200.00)/3) *2 = € 53.33 In case you would prefer a voucher to use the unfinished hours at a later moment, then this is possible as well.
If a kitesurf course is part of a holiday package:
Since our packages are strongly discounted different rules apply. In the event that we were unable to provide 90% of the reserved kitesurf course and one the following conditions are met:
(a) that the wind conditions prohibited you from completing your course (the wind is under 8 knt or over 30 knt). The unused hours will be refunded for 50%
Example: You bought a kitesurf package with 15 hours of group lessons. The price for these 15 hours is € 330,- but you received 25% discount, so you paid 330*75% = € 247.50. In case you were able to only spend 10 hours the following calculation will be made for your refund: (€ 247.50/15)*(15-10)* 50% = € 41.25.
In case you would prefer a voucher to use the unfinished hours at a later moment, than this is possible as well.
While on a kitesurf package we offer you the possibility to exchange your kitesurf hours for other activities if one of the following conditions are met: (a) that the wind conditions prohibited you from completing your course (the wind is under 8 knt or over 30 knt).
In case you bought group lessons:
You can exchange 4 hours of your kitesurf course for any other activity that you agree upon with our office staff. You can also exchange 100% of the value of your hours for an extension of your stay (this only applies in case this is not in conflict with other reservations).
In case you bought semi private lessons:
You can exchange hours of your kitesurf course for any other activity that you agree upon with our office staff. You can also exchange 100% of the value of your hours for an extension of your stay (this only applies in case this is not in conflict with other reservations).
While on a kitesurf rental package we offer you the possibility to exchange your rental hours for other activities if one of the following conditions are met: (a) you have given us 48 hours notice of your decision to cancel or (b) that the wind conditions prohibited you from the materials rented (the wind is under 10 knt or over 28 knt). You can exchange hours of your rental package for any other activity that you agree upon with our office staff. You can also exchange 100% of the value of your hours for an extension of your stay (this only applies in case this is not in conflict with other reservations).
We reserve the right to terminate your booking without further notice for you and/or any member of your party, whose behaviour is likely, in our opinion, to cause distress, damage, danger or annoyance to us, our staff, fellow guests, any 3rd party or property. Upon such termination our responsibility to you and your booking ceases and we shall not be liable for any costs incurred by you or any member of your party.
