LIABILITY WAIVER

*** READ EVERY WORD BEFORE SIGNING ( No Excuses ) ***

In consideration for the Kitesurfing, Windsurfing, Kite foiling and Wing foiling services, the renting of equipment, the use of the facilities, ground school, instruction, premises, and equipment of PAROSKITE:

“PARTICIPATION IN THE SPORT” means engaging in the sport of Kitesurfing / Kiteboarding, Windsurfing, Kite foiling and/or Wing foiling and includes all activities involving the setup, use and breakdown of the equipment, and further includes the giving or receiving of assistance or instruction in the sport of Kitesurfing / Kiteboarding, Windsurfing, Kite foiling and/or Wing foiling.

I (write name)__________________________, fully understand that Kitesurfing / Kiteboarding, Windsurfing, Kite foiling and Wing foiling (The Activities) are considered to be  “extreme sports” due to their inherent and numerous risks. I understand that (The Activities) have inherent dangers that no amount of care, instruction, or expertise can totally eliminate. I expressly ASSUME ALL RISK of personal injury while participating in The Activities.

Some of the risks may include:

• Being lifted by the kite and then dropped or even slammed onto the ground / water
• Severe cuts (lacerations) due to contact with kite lines under tension
• Unpredictable contact with sea life: sea urchins, etc.
• Unknown underwater conditions / objects: Sharp shells, broken glass, oyster beds etc.
• Being dragged by the kite.
• Changes in weather conditions: Increasing wind, Lightning, water spouts, updrafts, etc.
• Equipment malfunction. ( e.g. Lines can get  twisted, tangled, or break, allowing the kite   to behave unpredictably.)

Kiteboarding poses risks of injury or even death. By signing this release, you are choosing to participate and thus assuming FULL responsibility.

I agree that I will operate Kiteboarding, Windsurfing, Kite Foiling and Wing Foiling. And/or equipment reasonably and safely so as not to endanger the lives of persons or property of any individual.

In the event of injury you agree to rely on your own personal health insurance to cover any medical or injury related expenses.

I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. Additionally, I agree to wear an approved personal flotation device (life jacket) and helmet while participating in this activity.

I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless PAROSKITE from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of PAROSKITE ‘s equipment or facilities, including any such claims which allege negligent acts or omissions of PAROSKITE.

Should PAROSKITE or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against PAROSKITE on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at PAROSKITE.

I have had sufficient opportunity to read this entire document.

I _________________________ Waive and Release all Liability of Any Type associated with Paroskite, Owner, principles, My Instructor(s), Teaching location(s),  Associated schools  and  Gear/Equipment manufacturers. I realise by participating in the sport of Kiteboarding / Kitesurfing and other kite sports I am risking any type of injury and I still choose to proceed.

I HAVE READ THIS RELEASE OF LIABILITY, WAIVER OF LEGAL RIGHTS AND ASSUMPTION OF RISK, FULLY UNDERSTAND ITS CONTENTS AND SIGN IT OF MY OWN FREE WILL.I have read and understood it, and I agree to be bound by its terms.

By signing this, I fully agree to the above Liability Waiver and accept its content.
